Terms of service

Irrespective of any terms and conditions in the Customer’s order forms, or irrespective of the Customer not reading the terms and conditions, acceptance (by retaining the Goods or any other method) of the Goods ordered by the Customer will be conclusive acceptance of the terms and conditions of sale contained herein.
Processing time and Rates
Orders will normally be dispatched same day if ordered before 3pm, otherwise next working day following the receipt of your order. There is no minimum to buy. Tamada currently uses Australia post  or ARAMEX, but you also have the choice to choose a courier service of your preference at checkout. Delivery fees are calculated according to postcode using schedule of fees provided by courier company.

Sydney Metro orders over $150 entitles you with FREE delivery. You can also come and collect your order from our warehouse for FREE. Please call us prior to coming as we operate by appointment. We will always try to accommodate your needs so if you need a special delivery outside those times on a short notice please call us and we will do our best to accommodate. We can also arrange weekend appointments, so please call us.

Local NSW: Newcastle, Wollongong, Orange, Central Coast,
Southern Tablelands, Blue Mountains, Gosford, Erina, Wyong, Nowra, Kiama, Hunter Valley . Takes 2-3 working days. 

Interstate:
Victoria: Melbourne, Albury, Wodonga, Bendigo, Geelong and more – 2-3 working days.
Queensland: Brisbane, Gold Coast, Toowoomba, Coffs Harbor, Sunshine Coast, Mackay, Maryborough, Bundaberg, Gladstone, Rockhmpton, take 1-4 working days to deliver. 
ACT: Cairns, Townsville – 3-7 working days
WA: Perth Deliveries are 7-10 working days.
SA: Adelaide – 5-7 working days. 
TAS: Hobart, Launceston – 3-7 working days

Orders Terms
By placing an order via this website, you make an offer to us to purchase the products you have selected based on these Terms & Conditions. Tamada Pty Ltd (Tamada) reserves the right to accept or reject your offer for any reason, including, but without limitation, the unavailability of any product, an error in the price or the product description posted on this website, an error in your order or a failure in your payment. If we cannot accept or process your order after payment is received, we will contact you by email or telephone. Your ability to purchase products and services from this the website may be terminated at any time by Tamada without notice. The products and services offered for sale are only available to individuals who can make legally binding contracts.
Prices
Prices for goods and allied services are subject to alterations without notice. Where the wine purchased is intended for resale by a licensed merchant, prices quote will be at landed unit cost unless otherwise stated. LUC prices include Wine Equalisation Tax but not GST, which will be added to every account. LUC prices will be supplied by email on request by licensed resellers.
Payment methods
Payment can be made either by direct deposit to the bank account stated on the invoice or by a credit card or cash upon delivery. The goods will not be dispatched until funds are cleared.
Payment Terms
Payment is required in advance, or within 30 days from invoice for approved credit holders. Credit facilities on any account may be withdrawn or varied at the discretion of Tamada Pty Ltd without notice to the purchaser. Tamada Pty Ltd reserves the right to charge interest at 3% per month on all owings outside agreed trading terms by the purchaser and, further, the purchaser agrees to reimburse Tamada for any legal expenses, collection expenses or bank charges incurred by Tamada in the recovery or attempted recovery of overdue monies. The placement of an order constitutes the acceptance of these terms.
Retention of Title
All goods delivered by Tamada remain the property of Tamada and the title of any goods does not pass to the purchaser until all debts owed to Tamada on any account, including interest, bank charges, legal fees and collection expenses are paid to Tamada in full. In this regard, the purchaser grants the right to Tamada to enter the purchaser’s premises, or any other premises where the goods are reasonably believed to be stored, without notice, to take possession of the goods. Notwithstanding the foregoing, it is agreed that the goods are at the entire risk of the purchaser from the time of delivery.
Claims Procedure
All goods will be at the Customer’s risk ex-warehouse. Any claims of whatever nature must be reported to Tamada within seven days of receipt of goods or the purchaser is deemed to forfeit any claims for damages or replacement against Tamada. Please quote invoice number, account name, delivery address and date, as well as all other relevant details pertaining to your claim.
Claims Liability
Subject only to the provisions of the Trade Practices Act which necessarily apply to the contract and cannot be excluded, all other implied terms, conditions and warranties are hereby expressly excluded and Tamada’s liability is limited to the cost of replacing the goods or the cost of obtaining equivalent goods; whichever is the lower amount.
Tamada will accept faulty stock (including label damage, dry breaks, leakers or short fills etc.) for replacement only if seals on bottles are intact and the agreed time period has not expired. Damaged stock found after delivery must be returned in the original carton for replacement. Restaurant returns are acceptable only if the product is delivered out of condition or otherwise proven defective because of seal failure.
In all cases, stock must be viewed and returned through an approved Tamada agent. Supply invoice number and delivery date must be provided in order to action replacement or credit. No replacement or credit will be forthcoming on stock broken or damaged on the purchaser’s premises.
Pallet Exchange
The purchaser agrees to exchange Tamada pallets that accompany the goods purchased, with pallets of a similar brand and condition. In the event that the purchaser is unable to exchange said pallets, the purchaser will be charged for the cost of the pallets at Tamada’s replacement cost.
